Terms of Service
These Terms of Service govern a FleetSniper subscription between Turnum, LLC (Turnum, we, us) and the person or organization purchasing it (Customer, you). Each individual using a Customer seat must also accept the account-use requirements of these terms. Please read the subscription, refund, warranty, and liability provisions before accepting.
Agreement and eligibility
These terms apply when you affirmatively accept them during purchase or account activation. “Customer” means the individual or organization purchasing the subscription. If you accept for an organization, you represent that you have authority to bind it. You must be at least 18 years old and legally able to enter this agreement. FleetSniper is currently offered only to customers based in the United States for business use.
The Cancellation and Refund Policy forms part of this agreement. The Privacy Policy explains information practices; accepting these terms does not waive privacy rights or replace consent where separately required. Support information explains how to contact us and does not create a guaranteed response time.
United States access and engagement only
FleetSniper is offered exclusively to customers based in the United States and to users physically located in the United States. If you are outside the United States, you are not authorized to access or use our website, product, or APIs; create or access an account; purchase a subscription; submit sales inquiries or other commercial requests; or otherwise seek or receive FleetSniper services. This restriction also applies to U.S. customers and their personnel while abroad.
Do not use a VPN, proxy, false location information, an intermediary, or another method to evade this restriction. We may deny or restrict access when your location cannot be established or appears to be outside the United States. Technical accessibility, delivery of a message, or acceptance of a payment in error does not grant permission to use FleetSniper contrary to this restriction.
This restriction does not prevent communications needed to cancel an existing subscription, request a refund, report a security issue, serve a legal notice, or exercise rights that applicable law does not permit us to restrict. Use hello@fleetsniper.com for these communications. Handling such a communication does not authorize product access or create an offer to provide services outside the United States.
Price and recurring payment
FleetSniper has one plan at US$299 per named user per month. All subscription charges are in U.S. dollars. Applicable sales tax is additional and is shown separately with the seat count and total amount due before you authorize payment.
When you authorize the subscription, you authorize the disclosed initial charge and subsequent monthly renewal charges to your selected payment method until cancellation. Keep billing and contact information accurate. Initial paid access begins after successful payment; unsuccessful initial payment does not begin the refund window.
Subscriptions renew monthly on the original paid-subscription signup day shown in the purchase confirmation, using UTC for the billing calendar. If that day does not occur in a month, renewal falls on the last day of that month; the original day applies again when available. A January 31 subscription therefore renews on February 28 (February 29 in a leap year), then March 31. The next renewal date and time will be shown with its time zone.
Adding and removing seats
An added seat is charged only for the remaining portion of the current billing period. All seats then renew together on the existing subscription renewal date. We disclose the prorated charge, applicable tax and updated recurring total before you authorize the addition.
Removing a seat takes effect at the end of its current paid period. Access remains available until then, and the removed seat is excluded from the next renewal. Ordinary removal does not provide a prorated refund. The guarantee and other express or legally required refund remedies remain available.
Cancellation and the refund guarantee
You may cancel future renewals anytime directly from your account or by emailing hello@fleetsniper.com. Email remains available if you cannot access the account, including while abroad. No sales call or explanation is required. An ordinary cancellation preserves access through the paid period and stops future renewals; it does not itself request a refund or deletion.
To stop the next renewal, complete account cancellation or have your email request reach our inbox before the disclosed renewal date and time. Our processing delay will not make a timely request late. If we charge a renewal because we delayed a timely cancellation, we will reverse that charge. We confirm the cancellation and access-end date.
Request the guarantee within 30 days of your first subscription payment and we will refund that payment in full, no questions asked. This covers every seat included in that first payment and separate charges for seats added during the same original 30-day window. Adding seats does not restart or extend the deadline. The guarantee does not promise a refund of ordinary monthly renewal charges.
The Cancellation and Refund Policy defines the request deadline, refund process and other remedies. Issuing the guaranteed refund ends the entire subscription and all its seats. Ordinary cancellation does not provide a prorated refund unless an express remedy or applicable law requires one.
Failed renewal payments
If a renewal payment fails, we send a notice to your account email and allow seven full 24-hour periods from that notice to resolve payment before suspending access for nonpayment. Access continues during that period. The notice identifies the issue, how to resolve it, and the exact deadline; the deadline is also available in the account. A failed notice send does not start the clock. If we learn that the notice could not be delivered, we will resolve the notification issue before suspending for nonpayment.
If payment remains unresolved after the grace period, we may suspend access and will stop further automatic renewals while the account remains suspended for nonpayment. We do not impose late-payment fees. Valid charges already incurred remain payable unless refunded, corrected or otherwise resolved. Before restarting renewals, we will disclose the amount and schedule and obtain your authorization. Security and misuse restrictions are separate from this payment grace period.
Named seats and account security
Each person using FleetSniper needs an individual paid, named seat. Do not share credentials, rotate a login among different people, resell account access, or allow an unlicensed person to use a seat. A business may reassign a paid seat to a replacement employee by contacting hello@fleetsniper.com. Reassignment replaces the former user’s seat access; it does not permit simultaneous use or shared credentials. The authorized business administrator chooses whether the replacement employee starts with a fresh workspace or receives the former employee’s business-workspace notes, saved lists, statuses, and working history through support.
Keep credentials confidential, use accurate account information, and promptly report suspected unauthorized access. An organization purchasing seats is responsible for its authorized users’ compliance with these terms. Payment alone does not establish administrative authority over an independently held personal account. Business-workspace reassignment requires verification of the business administrator’s authority.
Permission to use FleetSniper
During an active subscription, we grant each authorized named user a limited, nonexclusive right to access and use FleetSniper for the Customer’s lawful business purposes, subject to these terms. You may use researched facts in your ordinary business work and include limited relevant excerpts in communications with colleagues, clients, insurers, or counterparties. This does not authorize sharing a login or giving others a substitute for their own FleetSniper access.
Without our prior written permission, do not resell data obtained through FleetSniper, bulk extract or scrape FleetSniper, use automated access except a function expressly made available for that purpose, republish a substantial portion of its compilation, or use data obtained through FleetSniper to build a competing database or service. These restrictions govern your use of FleetSniper; they do not restrict public records you obtain independently or rights that applicable law does not permit us to restrict.
Turnum and its licensors retain their rights in FleetSniper’s software, design, branding, and protectable compilation elements. We do not claim ownership of underlying public government records. Do not remove proprietary notices or reverse engineer the software except to the extent applicable law permits despite this restriction.
Your content and private workspace
You retain any rights you hold in notes and other content you submit. You grant Turnum and its service providers a nonexclusive permission to host, copy, transmit, and otherwise process that content only as reasonably needed to provide, secure, maintain, and support FleetSniper, respond to your instructions and verified business-administrator instructions for business-workspace reassignment, and meet applicable legal obligations. This permission lasts only while the content is retained for those purposes under the Privacy Policy.
You are responsible for having the rights and permissions needed to submit content. Do not submit passwords, payment-card details, government identity numbers, medical records, or other sensitive personal information unnecessary for commercial carrier research.
Notes, lists, statuses, and working progress are kept in separate workspaces, subject to the authorized business-workspace reassignment described above. Turnum will treat nonpublic workspace content as confidential, limit access to personnel and providers who need it for the permitted purposes and are subject to confidentiality obligations, and disclose it otherwise only with your authorization or as described in the Privacy Policy. Account privacy does not mean Turnum and its providers cannot access content to operate or support the service.
Before an employee uses a business-managed workspace, FleetSniper will clearly disclose that an authorized business administrator may arrange its transfer to a replacement employee. The business is responsible for having the authority to request that transfer and for providing any additional employment or privacy notices required of it. A transfer does not include authentication credentials or unrelated personal account information and does not determine ownership of intellectual property or waive applicable privacy rights.
The Privacy Policy describes retention after access ends. Reactivation within the retention period preserves the retained workspace; reactivation does not create a right to recover content already deleted or to bypass an unresolved security or eligibility restriction.
Responsible use and individual eligibility decisions
Do not use FleetSniper to harass, discriminate unlawfully, impersonate others, distribute malicious software, bypass access controls or usage limits, interfere with the service, or obtain another user’s information. You are responsible for the laws governing your outreach and use of contact information, including calling, texting, email, privacy, and suppression requirements. A publicly listed phone number or email address is not proof of consent to receive marketing.
Do not use FleetSniper for a purpose governed by the Fair Credit Reporting Act or a similar consumer-reporting law, including evaluating an individual’s eligibility for credit, insurance, employment or housing when that law applies. This restriction includes covered decisions about individual drivers or sole proprietors within commercial transactions. Do not submit consumer reports to FleetSniper. This restriction does not represent that a label or disclaimer determines which laws apply.
Source information and business decisions
FleetSniper organizes source records. It does not make underwriting, coverage, hiring, credit, carrier-selection, or other business decisions for you, and it is not a government agency or an official certification of a carrier. You remain responsible for your decisions and for verifying relevant information against appropriate current sources.
Coverage, reporting dates, and available history vary by carrier and source. Records can be incomplete, delayed, inaccurate, or inconsistent. An absent or unavailable record does not establish no insurance, no violations, or a clean safety record. A filing date is not necessarily a renewal date, and an inspection location is not a current route or live location.
Government and other third-party services referenced by FleetSniper operate under their own terms. A reference is not a promise that a third-party service will remain available or correct a record.
Suspension and termination
We may restrict access to the extent reasonably necessary to address a material breach of these terms, unpaid charges subject to the renewal-payment grace period, a credible security threat, unlawful activity, or a legal requirement. For an ordinary violation that presents no urgent risk, we will give notice explaining the issue and a reasonable opportunity to fix it before suspending access.
We may suspend access immediately, without advance notice or an opportunity to cure, when we have a reasonable basis to believe an account is being used for unauthorized scraping, bulk extraction or copying, resale, building a competing database or service from FleetSniper data, credential theft, or unauthorized access. We may also act immediately when delay would create a material security risk or violate law. This exception does not apply merely because you share limited research excerpts as permitted by these terms or use public records obtained independently. Contact hello@fleetsniper.com if you believe a suspension is mistaken; we will review the action and restore access if it was unwarranted.
We may terminate a subscription for a material breach that remains unresolved after a reasonable opportunity to cure, or immediately for a serious breach that cannot reasonably be cured. We may also discontinue the service or end a subscription without Customer fault; in that case, we will give reasonable advance notice when practicable, stop renewals, and refund prepaid fees for the unused service period.
Suspension or termination does not eliminate the first-payment refund guarantee or a remedy required by law. A first-payment refund ends access when issued. When access ends, authorization to use the service ends; data retention and deletion remain governed by the Privacy Policy. Provisions concerning accrued payment obligations, content retained for permitted purposes, confidentiality, intellectual property, liability, and disputes continue to the extent needed to give them effect.
Service changes and warranties
We may maintain, update, or change FleetSniper. If we discontinue or materially reduce the core paid service during a prepaid period, you may end the affected subscription and receive a refund for the unused portion of that period. This remedy does not reduce your first-payment guarantee or nonwaivable rights.
To the fullest extent permitted by applicable law, and except for express commitments in this agreement, FleetSniper and source information are provided as available and as is. Turnum disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement, and does not warrant uninterrupted or error-free service, complete or current source information, or any particular sales, insurance, or business outcome.
These disclaimers do not excuse our express confidentiality commitments, reduce the refund promise, or exclude any warranty or obligation that applicable law does not permit us to exclude.
Limitation of liability
To the fullest extent permitted by applicable law, Turnum will not be liable under or in connection with this agreement for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, or goodwill, even if advised of the possibility of those losses.
Turnum’s total aggregate liability for monetary damages arising out of or relating to FleetSniper or this agreement will not exceed the greater of US$299 or the subscription fees paid or payable by the Customer for FleetSniper during the 12 months immediately preceding the first event giving rise to the claim. This is one aggregate cap across claims, legal theories, and the Customer’s seats; it is not a separate cap for each user or incident.
The exclusions and cap apply to the fullest extent permitted by applicable law, regardless of the legal theory asserted, including contract, tort (including negligence), statute, or otherwise. They do not exclude or limit liability, damages, or remedies to the extent applicable law prohibits that exclusion or limitation. No provision of this agreement waives a right that cannot lawfully be waived. Our express obligations to pay refunds under this agreement remain payable in full and are not reduced by this damages cap.
Changes to terms or price
We will identify each effective version of these terms. Material changes will be communicated to the account email with the proposed effective date and cancellation instructions before they apply. We will obtain renewed acceptance where required by law; merely posting new terms does not change an already accrued claim.
A price increase will not change the price of an already paid subscription period. Any future change must be disclosed before the affected renewal with the notice and consent required by applicable law. You may stop future renewals before a change takes effect.
Disputes and general provisions
You may contact hello@fleetsniper.com to try to resolve a dispute. This is voluntary and does not delay a filing deadline, require exhaustion of support, or restrict access to courts, regulators, or payment-dispute procedures. These terms do not impose mandatory arbitration or waive class actions or jury trials.
Ohio law governs this agreement and disputes arising out of or relating to it, without applying conflict-of-laws rules that would require another jurisdiction’s law, except to the extent applicable law requires otherwise. This choice does not deprive you of any protection or remedy that cannot lawfully be waived by agreement.
Except where applicable law requires otherwise, any court proceeding arising out of or relating to this agreement or FleetSniper must be brought exclusively in a state court of competent jurisdiction in Hamilton County, Ohio, or, if federal subject-matter jurisdiction exists, in the United States District Court for the Southern District of Ohio sitting in Cincinnati. Each party consents to personal jurisdiction and venue in those courts. This clause does not create federal subject-matter jurisdiction, prevent complaints to regulators or payment providers, or restrict a court or remedy that applicable law does not permit the parties to exclude.
These terms, the Cancellation and Refund Policy, and your accepted purchase summary form the subscription agreement. The purchase summary controls the seat count and disclosed charges; the Cancellation and Refund Policy controls if there is a conflict about the first-payment guarantee. A separately signed agreement controls an express conflict with these terms. A purchase order does not add terms unless we expressly accept them in writing.
If a provision is unenforceable, it is severed only to the necessary extent and the remaining provisions continue where legally permitted. A failure to enforce a provision is not a waiver. Neither party becomes the other’s agent, partner, or employee under this agreement.
You may not transfer the subscription to a different Customer without our written consent. Turnum may transfer this agreement in connection with a merger, reorganization, or sale of the business serving FleetSniper if the successor assumes the obligations and the transfer complies with applicable law. Such a transfer does not itself authorize new uses of personal information.
